Breach of Contract of Employees and Without Notice Period

At House of Klothberg, we are committed to maintaining a workplace grounded in respect, professionalism, and ethical behavior. All employees are expected to adhere to the company’s Code of Conduct and uphold the values and responsibilities outlined in their employment agreements.

Definition of Breach

A breach of the Code of Conduct includes, but is not limited to:

  • Disrespectful, abusive, or discriminatory behavior.

  • Harassment of any kind—verbal, physical, or digital.

  • Unauthorized disclosure of confidential company information.

  • Misuse, damage, or theft of company property or resources.

  • Absence from work without approval or justification.

  • Failure to follow internal policies or managerial instructions.

  • Resignation without serving the required notice period.

Notice Period Requirement

Any employee who wishes to resign must inform the company at least one month (30 days) in advance through a formal written notice. This notice period is mandatory and is essential for ensuring a smooth handover and minimizing disruptions in workflow.

Failure to provide proper notice will be considered a breach of contract, and may result in:

  • Deduction of salary equivalent to the shortfall in notice period.

  • Withholding of relieving letters, experience certificates, or other documentation until formal clearance.

  • Termination marked as “Breach of Contract,” which may impact reference verifications.

  • Legal action if business losses occur as a result of the early or unapproved exit.

Consequences of Breach

If an employee violates any part of this Code of Conduct, the company may take disciplinary action based on the severity of the offense. This may include:

  • Verbal or written warnings.

  • Suspension or probation.

  • Salary or benefit deductions (as per policy and legal framework).

  • Termination without further notice.

  • Legal proceedings where necessary.

Review & Investigation

All reported breaches will be thoroughly and fairly investigated by the HR and management teams. Employees will have the opportunity to explain or respond to any allegations before a decision is made.

Zero Tolerance Policy

The company enforces zero tolerance for serious violations such as harassment, fraud, and unethical conduct. All employees are expected to maintain high standards of behavior and accountability.
